H. Notarial Certificates: Jurat and Acknowledgment

1. JURAT

a. Requisites

1) Personal appearance;

2) Oath-taking or swearing in before a solemnizing officer; and

3) Signing in front of the said solemnizing officer.

b. Magic words

Subscribed and sworn to before me | on [insert date] | at [insert: city] | affiant having exhibited to me his competent evidence of identity [insert: Government ID details] | issued by [insert: Government Agency/Office] on [insert: date of issuance]

c. Reminders

1) Jurat may be made by a notary public or anyone solemnizing officer (e.g. prosecutor, labor arbiter, etc.). 2) If done before a notary public, notarial details have to be provided (e.g. doc number, page number, book number, series of).

2. ACKNOWLEDGMENT

a. Requisites

1) Personal appearance;

2) Acknowledgment of having signed the document before a notary public; and

3) Attesting to the voluntariness or willfulness of the act of signing.

b. Magic words

Before me | on [insert: date] | at [insert: city/municipality], Philippines | personally appeared [insert: COMPLETE NAME OF AFFIANT] | with competent evidence of identity [insert: Government ID details] | issued by [insert: Government Agency/Office] on [insert: date of issuance] | known to me to be the same person who executed the foregoing instrument | and he/she acknowledged to me that the same is his/her free act and deed.

c. Reminders 1) The acknowledgement shall be made before a notary public or an officer duly authorized by law of the country to take acknowledgments of instruments or documents in the place where the act is done. (Gamido v. New Bilibid Prisons [NBP] Officials, supra.)
